MP3 or Ogg Vorbis

Of course there is lots of news about mp3 licenses and law suites. However, engadget suggests that perhaps the solution is just to use ogg vorbis. But the article sort of contradicts itself stating that mp3 builds on earlier work. I think the same logic applies to ogg vorbis then. It, too, also would seem to build on previous work (patented and not). Thus the logical conclusion would be that using ogg vorbis likely means you are infringing on patents in this space.
